Tax services & IRS matters

Nothing inspires greater fear than being contacted by the IRS. As a former lawyer for the IRS, with over 30 years of experience, I know how to navigate the tax system to provide clients with solutions to their tax problems.

Matters handled

  • Audits
  • Appeals
  • Collections — lien, levy and garnishment; installment agreements; offers in compromise; innocent spouse relief
  • Business and employment taxes
  • IRS penalties and penalty abatement
  • Tax refunds
  • Trust Fund Recovery Penalty appeals
  • Unfiled tax returns
  • US Tax Court litigation

Bankruptcy

Bankruptcy may be a solution to your financial problems. With more than 30 years of experience representing debtors, I can evaluate your situation to determine whether bankruptcy is your best option.

Matters handled

  • Chapter 7 — a liquidation proceeding
  • Chapter 11 — reorganization of the debtor
  • Chapter 13 — a payment plan lasting 3 to 5 years*
  • Creditor representation — proofs of claim, motions to lift stay, preference and fraudulent-transfer defense, objections to discharge and to plans

*Notice under Florida Bar Rule 4-7.12(b): A debtor who contacts my office and chooses to file a Chapter 13 bankruptcy may be referred to another attorney for representation.

Estate planning & probate

It is difficult to face end-of-life issues. With proper estate planning you can alleviate the legal burdens for your loved ones resulting from diminished capacity and death.

Matters handled

  • Will or last will and testament
  • Power of attorney
  • Living will
  • Medical directive
  • Probate — formal and summary administration

Business services

When starting a new business your first step should be to consult with a lawyer. Entity formation, contracts, tax ramifications and intellectual property are just some of the issues that may need to be addressed.

Matters handled

  • Choosing the entity — corporation, S corporation, LLC or partnership — and how it will be taxed
  • Formation paperwork and tax identification numbers
  • Licensing requirements
  • Leases and contracts — review and drafting
  • Employee or independent contractor determination
  • Intellectual property issues
  • Tax filing requirements
  • Bankruptcy issues affecting the business as a creditor

From the tax practice

If the IRS contacts you.

  1. First and foremost, do not panic.
  2. Determine if it is really the IRS.The IRS will not call you, e-mail you or text you. Their initial communication will come by mail through the US Post Office.
  3. Do not speak to the IRS on your own. They are not your friend, and anything you say can hurt your case.
  4. Seek legal help. You have the right to hire a lawyer who can represent you before the IRS. The attorney needs to be qualified to handle your case from the audit to Tax Court and collection.

Magda Abdo-Gomez, Attorney at Law

I have been representing taxpayers, both individuals and businesses, before the IRS and in the US Tax Court for over 30 years. Before going into private practice I represented the IRS in the US Tax Court and Bankruptcy Court. My practical experience, legal knowledge and familiarity with tax law and IRS procedures has allowed me to help taxpayers throughout the United States obtain favorable results, and my knowledge of bankruptcy enables me to provide debtors much needed debt relief and a fresh start. Although each case is different, and results are not guaranteed, you can be sure that I will do everything legally possible to fight for your rights.

The hiring of a lawyer can be a difficult and confusing task. The decision should not be taken lightly and should not rely on advertisements alone. What makes me different from other lawyers is the personal approach I give to every case: I will personally handle your case from start to finish. Clients are encouraged to discuss their goals and are involved at all times in the decision-making process regarding their case.
